2. Heard the learned counsel for the appellants, and learned counsel for the respondents and perused the material available in the record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on both sides, this petition is allowed.

4. Registry is directed to carry out necessary amendment in the cause title with regard to the death of the sole respondent in S.A.No.571 of 2004, if the papers are otherwise in order.
