O R D E R

This writ petition is filed against the order rejecting the application of the petitioner for Domestic Electricity Service Connection.

2. The petitioner made an application for the Domestic Electricity Service Connection, which has been rejected by the respondent / Board on the objection received from a 3rd party and after obtaining a legal opinion from the Government Advocate. The grievance of the petitioner is that the petitioner has not been provided with any opportunity to establish his case that he is legally in occupation of the property and he is having valid documents to substantiate his case.

3. Since the application of the petitioner for domestic service connection has been rejected without providing any opportuity to the petitioner to substantiate his case, the impugned order of rejection passed by the 2nd respondent is set aside and the respondent / Board is directed to consider the petitioner's application afresh by providing him an opportunity and to take the decision within a period of three weeks from the date of receipt of a copy of this order.

4. With the above directions, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
