2025-07-11Honourable Mr Justice C.V. Karthikeyan2 pages

C.M.P.Nos.7812, 7813 & 7814 of 2025 in S.A.No.624 of 2011 C.V.KARTHIKEYAN, J.

These petitions have been filed to condone the delay of 2830 days in filing petition to set aside abatement consequent to the death of the Dharmakartha of the three respondent Temples, Vedhachala Gounder, to set aside abatement and to bring on record his son as a further respondent / 9th respondent in the appeal. 2.Notice had been directed and there is a representation on behalf of the proposed respondent. But impleading this respondent would not enable the appellant to proceed further with the appeal since it is contended that the present Dharmakartha of the three respondent Temples will have to be impleaded, who would be in a better position to give necessary instruction. 3.At any rate, these petitions stand allowed in view of the facts surrounding the case. The Registry to carry out necessary amendment reflecting the death of the Vedhachala Gounder who is shown as Dharmakartha and impleading independently the 9th respondent, but care should be taken that he is not shown as the Dharmakartha of the three respondent Temples. 11.07.2025 smv C.V.KARTHIKEYAN, J.
