No.61 of 2007 on the file of the Subordinate Judge and Appellate Authority of Coimbatore, confirming the decree and judgment dated 13.02.2007 passed in O.S. No.3256 of 2004 on the file of the I Additional District Munsif Court at Coimbatore.

JUDGMENT

When the matter is taken up for hearing today, there is no representation for the appellant.

Mr.N.Manokaran, learned counsel appearing for the respondents contended that the sole appellant died even in the year 2017 and the first respondent also died and till date, no steps have been taken to bring on record the legal heirs of the deceased sole appellant and the first respondent. A perusal of the records also confirms the same.

3. In view of the above, the Second Appeal is dismissed as abated. No costs.
