Respondent/Plaintiff Prayer:- This Memorandum of Second Appeal is filed under Section 100 of Code of Civil Procedure, against the Judgment and decree dated 29.01.2008 passed in A.S.No.1 of 2005 on the file of the learned Additional District Judge, (Fast Track Court No.2), Gobichettipalayam confirming the judgment and decree dated 07.12.1990 passed in O.S.No.633 of 1983 on the file of the learned District Munsif, Gobichettipalayam.

J U D G M E N T

Today, when this appeal came up for hearing, the learned counsel appearing for the appellants appeared before this Court through Video Conferencing and represented that they are not having any instructions from the appellants. The said submission is recorded.

2. Further, on verification of records, it appears that this appeal is posted for taking steps to implead the legal representatives of the deceased sole respondent, who died on 26.09.2011.

sole respondent and also in view of the submission made by the learned counsel for the appellants, the instant Second Appeal is dismissed for default. No Costs.
