ORDER
This writ petition has been filed seeking for a direction to the respondents 1 and 2 to survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition and for issuance of separate patta in the name of the petitioner, based on the petitioner's representation dated 24.12.2025 within a time frame to be fixed by this Court.
2. The petitioner claims that he is the owner of the property morefully described in the prayer to this writ petition. He has given a representation on 24.12.2025 to the second respondent, seeking for survey and demarcate the and for issuance of separate patta in the name of the petitioner. Since the same has not been considered till date, the petitioner has filed this writ petition.
3. Mr. S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents 1 and 2 and would submit, on instructions, that no online application has been filed by the petitioner till date. Once online applications, seeking for seeking for survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition and for issuance of separate patta in the name of the petitioner, are filed by the petitioner, the same will be considered by the respondents. Mr.Venkatatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the fourth
respondent.
4. No prejudice will be caused to the respondents 1 and 2 if the said authorities are directed to survey and demarcate the boundaries of the petitioner's property, morefully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party whom they deem it fit to enquire and issue separate patta in the name of the petitioner once online applications, seeking for survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition and for issuance of separate patta in the name of the petitioner, are filed by the petitioner within a time frame to be fixed by this Court.
5. For the foregoing reasons, this writ petition is disposed of by issuing the following directions:
a) The petitioner is directed to submit online applications, seeking for survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition and for issuance of separate patta in the name of the petitioner within a period of one week from the date of receipt of a copy of this order;
b) On receipt of the said online applications from the petitioner within the stipulated time, in so far as the application seeking for survey and demarcate the
is concerned, the respondents 1 and 2 are directed to survey and demarcate the within a period of 12 weeks thereafter;
c) If the petitioner is eligible for the issuance of separate patta in his name for the property surveyed and demarcated by the respondents 1 and 2, the first respondent shall also consider the application if so submitted for issuance of patta for the property in favour of the petitioner on merits and in accordance with law within a period of eight weeks from the date when the survey and demarcation of boundaries is completed after hearing all the necessary parties; d) If the need arises for police assistance and on a request made by the respondents 1 and 2, the third respondent shall render police assistance for the effective implementation of this order.
