ORDER
This writ petition has been filed to direct respondents 1 and 2 to issue appropriate orders/directions to the third respondent to consider the petitioner's representation dated 11.12.2025 and restore and re-issue the patta for the property, morefully described in the prayer to this writ petition in the name of the petitioner and other co-owners, within the stipulated time to be fixed by this Court.
2.The petitioner claims that the property, morefully disclosed in the affidavit filed in support of this writ petition, was earlier the subject matter of land acquisition by the respondents. However, by an order dated 23.07.2014 passed by the Division Bench of this Court in W.A. No.835 of 2014, the land acquisition was quashed. The petitioner also claims that he has been put back in possession, pursuant to the orders passed by this Court in a writ petition filed by the very same petitioner. Under those circumstances, the petitioner had sought for restoration of the patta in his name and the other co-owners' name for the subject property from the official respondents. The petitioner had submitted a representation for the said purpose with the official respondents on 11.12.2025. According to the petitioner, till date, the representation of the petitioner dated 11.12.2025 seeking for re-issuance of patta in the name of the petitioner and the other co-owners for the property, morefully described in the prayer to this writ
petition, has not been considered. Under such circumstances, this writ petition has been filed.
3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.
4.The petitioner has filed supporting documents, which include the order of the Division Bench quashing the land acquisition proceedings. This Court is not expressing any opinion on the merits of the petitioner's representation. 5.No prejudice would be caused to the respondents if the petitioner's representation seeking for re-issuance of patta for the property, morefully disclosed in the prayer to this writ petition, is considered on merits and in accordance with law, in the light of the order dated 23.07.2014 passed by the Division Bench of this Court in W.A. No.835 of 2014, within a time frame to be fixed by this Court.
6.Learned Special Government Pleader appearing for the respondents would submit that the orders passed by the learned Single Judge in the writ petition as well as in the Contempt Petition, which have been enclosed in the typed set of documents filed by the petitioner, are not binding on the official respondents as they were not parties to the said proceedings.
7.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 11.12.2025 seeking for restoration of patta for the property, morefully disclosed in the prayer to this writ petition in the name of the petitioner and other co-owners name, after giving due consideration to the order dated 23.07.2014 passed by the Division Bench of this Court in W.A. No.835 of 2014, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
