O R D E R
[Order of the Court was made by P.N.PRAKASH, J.] This Habeas Corpus Petition is filed by the wife of the detenu Jayaraman for a direction to the respondent to produce the detenu before this Court and set him at liberty.
2. It is the case of the petitioner that her husband went missing on 08.04.2015, in connection with which, a case in Crime No.1215 of 2015 has been registered for man missing. The allegation of the petitioner is that since the respondent - police did not take effective steps to secure the detenu, she has filed the present Habeas Corpus Petition.
3. Today, when the matter was taken up for hearing, learned Additional Public Prosecutor has filed status report dated 19.01.2016, wherein the respondent - police has narrated the steps taken by them to secure the detenu. In the status report, it is stated as follows:
"I further submit that a Special team was formed headed by Tmt.Velammal, Sub Inspector of Police along with Tr.Jaheer Hussain H.C-13724, Tr.Venkatesan, HC-20991 and the special team visited to the following places namely:
Mylapore, Triplicane, Parrys, Coimbedu, Tambaram, Egmore, Perungalathur, Arakkonam, Chengalpattu, Kancheepuram, Tiruvallur Districts and sorrouding areas and enquired about the Missing man Jayaraman and showed his photo to the public and pasted the phamplets of public gathering places, i.e. Temple, Bus stand, Shopping mall, Railway Stations, Markets, Theatre, Auto Stands, Hotel lodges in above mentioned areas, but we could not able to get any fruitful information about the missing man Jayaraman.
6. I respectfully submit that on various dates the special team visited to the all Government hospitals situated at Chennai along with the relative of the detenue and enquired about the missing man viz., Jayaraman and also visited Central Prison, Puzhal, but no clue was found by the special team about the missing man viz., Jayaraman."
4. In view of the above, we find that it is not a case of illegal detention warranting issuance of a Writ of Habeas Corpus. Accordingly, this Habeas Corpus Petition stands closed with a direction to the respondent - police to proceed with the investigation in Crime No.1215 of 2015 and keep the petitioner informed about the developments, if any, in this case. -sdAssistant Registrar, //True Copy// Sub-Assistant Registrar
