ORDER

This petition has been filed seeking a direction to the respondent to release the earned leave salary in the light of the order passed in WP.8152 of 2021 dated 1.12.2021 along with interest from the date of retirement without any reference to the enquiry report dated 12.9.2025 based on which no final penal order has been passed till date.

2. It is the case of the petitioner that he is a retired quality Inspector of the respondent Corporation and was permitted to retire on 31.05.2014 without any prejudice to pending recovery order. After a lapse of five years, the respondent passed a recovery order dated 24.01.2019 and unlawfully adjusted the petitioner's earned leave salary. The said recovery order was quashed by this Court vide order dated 01.12.2021 and directed the respondent to proceed afresh or pass a final order within a period of eight weeks. Neither a final order was passed within the stipulated period, nor was any extension sought by the respondent. Despite the quashing of the recovery order, the respondent continues to withhold the petitioner's earned leave salary, relying only on an enquiry report dated 12.09.2025, which cannot substitute a final order. Hence, the petitioner made a representation on 13.11.2024 to release the earned leave salary in the light of the order passed by this Court dated 01.12.2021 and the same is not considered. Hence, the present writ petition has been filed.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner has not made any representation so far.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the petitioner to make a fresh representation to the respondent along with all the relevant documents and also a copy of this order within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the said representation, the respondent shall take a decision in accordance with law within a period of six weeks thereafter.
