O R D E R

This Contempt Petition has been filed alleging willful disobedience of the order dated 09.12.2024 passed in Crl.O.P.No.30590 of 2024.

2. The petitioner had earlier filed Crl.O.P.No.30590 of 2024 seeking a direction to the respondent-Police to file a final report in Crime No.342 of 2022 dated 10.11.2022. When the matter was taken up for hearing on 09.12.2024, the learned Additional Government Pleader appearing for the respondent-Police submitted that a charge sheet had already been filed before the XVII Metropolitan Magistrate Court, Saidapet, through E-filing No.LTN 20230001097C2024 00099, dated 07.12.2024. Recording the said submission, this Court disposed of the Criminal Original Petition on 09.12.2024.

According to the petitioner, when he applied for a certified copy of the charge sheet before the XVII Metropolitan Magistrate Court, Saidapet, Chennai, an endorsement made by the said Court disclosed that no charge sheet had been filed under the aforesaid E-filing number. Contending that an incorrect statement had been made before this Court regarding the filing of the charge sheet, the petitioner has instituted the present Contempt Petition.

4. When the contempt petition was taken up for hearing on 24.04.2026, this Court called for the original records relating to Crime No.342 of 2022 from the file of the XVII Metropolitan Magistrate, Saidapet, Chennai.

Today, on a perusal of the original records, it is seen that the respondent police had, in fact, filed a closure report in Crime No.342 of 2022 before the XVII Metropolitan Magistrate, Saidapet, Chennai, concluding that the dispute is civil in nature and leaving it open to the petitioner to work out his remedy in the manner known to law. The records further reveal that notice regarding the closure report has already been issued to the petitioner.

6. In view of the above, this Court is satisfied that the investigation has culminated in the filing of a final report. It is open to the petitioner to file a protest petition, if not already filed before the jurisdictional Court. In the event of filing of such protest petition, the learned Magistrate shall consider and dispose of the same on merits and in accordance with law.
