ORDER

(Order of the Court was made by S.M.Subramaniam J.) The present Contempt Petition has been instituted to punish the respondent for wilful disobedience of the orders of this Court dated 07.08.2023 in WP.No.30219 of 2022.

2. The learned Special Government Pleader would submit that during September 2024, the Authorities have already removed the obstructions caused in the pathway and now the pathway is open to the public.

3. The learned counsel for the petitioner would oppose by stating that the pond in that locality is not restored by the Authorities.

4. A perusal of the photographs would show that irrigation is going on in the entire locality and the pathway alone is to be maintained properly by the Authorities to ensure that the pathway is capable of using by all the farmers and people of that locality. Thus, the respondents shall ensure that no encroachments are allowed in public pathway and if there is any pond as stated by the petitioner as per the revenue records, further action is to be taken in the manner known to law.
