ORDER
Heard Mr.R.Singaravelan, learned Senior Counsel appearing for M/s.M.Srividhya learned counsel appearing for the petitioner; Mr.P.Sanjay Gandhi, learned Additional Government Pleader appearing for the respondents 1 and 2.
2. The petitioner challenges the proceedings dated 28.01.2014 in and by which he was dismissed from the post of Panchayat Assistant.
3. The learned senior counsel appearing for the petitioner would submit that as against the order of the dismissal, the petitioner has filed the Statutory Appeal before the first respondent and it is pending.
4. In view of the pendency of the Statutory Appeal before the first respondent, I do not think it will be in the fitness of things to interfere with the order of dismissal passed by the second respondent in this writ petition under Article 226 of the Constitution of India. Hence the first respondent is directed to dispose of the Statutory Appeal filed by the petitioner after giving an opportunity to the petitioner within a period of twelve weeks from the date of receipt of a copy of the order.
5. Accordingly, this writ petition is disposed of with the above direction. No costs. Consequently, all the connected miscellaneous petitions are closed.
