JUDGMENT

The learned counsel appearing on behalf of the appellant made a submission that, during the pendency of the present Civil Miscellaneous Appeal, the subject property was taken over by the Government. The said fact was ascertained by the learned counsel for the appellant on getting instructions. In view of the fact that the subject property itself was taken over by the Government, as instructed by the appellant, the learned counsel made a submission that no further adjudication is required, and accordingly, the Civil Miscellaneous Appeal is dismissed.
