ORDER

The petitioner has filed this petition seeking to modify the conditional amount imposed in the order dated 19.07.2024 made in Crl.M.P.No.10172 of 2023 in Crl.A.No.1429 of 2023.

2.Heard the learned Senior Counsel appearing for the petitioner, the learned Additional Public Prosecutor appearing for the first respondent and the learned counsel appearing for the second respondent.

3.The learned counsel appearing for the petitioner submitted that this Court while granting suspension of sentence directed the petitioner to deposit a sum of Rs.20 Lakhs to the credit of C.C.No.6 of 2020 on the file of the learned Special Judge, Special Court under the Tamil Nadu Protection of Interests of Depositors (in Financial https://www.mhc.tn.gov.in/judis

Establishments) Act, 1997, Chennai, however, the petitioner is not able to deposit the said amount and further submitted that the petitioner is in prison for more than nine months. Hence this Court may reduce the conditional amount and prayed to modify the condition.

4.In view of the above, this Court is inclined to modify the conditional amount. Accordingly, the amount in respect of A.Srimathi (A-9) in the tabular column in paragraph no.33(1) of the order dated 19.07.2024 made in Crl.M.P.No.10172 of 2023 in Crl.A.No.1429 of 2023 is modified as Rs.5,00,000/- (Rupees Five Lakhs Only) instead of Rs.20 Lakhs and the petitioner shall deposit the said amount to the credit of C.C.No.6 of 2020 on the file of the learned Special Judge, Special Court under the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Chennai, within a period of two weeks from the date of receipt of a copy of this order. The other conditions stand un-altered.

The learned Special Judge, Special Court under the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Chennai shall disburse the amount so deposited by the petitioner herein, in appropriate proportion amongst the depositors on the basis of the deposits made by each of the depositor by arriving at the proportional amount after proper verification of deposit receipts and under due acknowledgment. 5.This miscellaneous petition is accordingly ordered.
