ORDER

2. The case of the petitioner is that the marriage between the petitioner and the respondent was solemnized on 01.02.2024 at Sunnathul Arafa Muslim Jamath Committee, Mannadi, Chennai.

3. The respondent/husband has instituted H.M.O.P. No.175 of 2025 on the file of the Family Court, Tiruvallur, seeking divorce, and that the matter is at the counter/enquiry stage. It is further submitted that the petitioner/wife is residing within Chennai jurisdiction and seeks withdrawal and transfer of the said H.M.O.P. to the Family Court at Chennai. The petitioner has also filed D.V.C.No.59 of 2025 before the XVI Metropolitan Magistrate, George Town, Chennai. The petitioner is dependent on her parents for support and repeated travel would impose disproportionate financial burden.

4. Having regard to the residence of the petitioner/wife at Chennai and considering the stage of the proceedings, this Court is satisfied that the request for transfer deserves acceptance, in the interest of convenience and effective participation in the proceedings.

Accordingly, this Transfer Civil Miscellaneous Petition is allowed. H.M.O.P. No.175 of 2025, pending on the file of the Family Court, Tiruvallur, is withdrawn and transferred to the file of the Family Court, Chennai. The Family Court, Tiruvallur, shall transmit the records to the Family Court, Chennai, within three weeks from the date of receipt of a copy of this order and the Family Court, Chennai shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order.
