O.P.No.448 of 2023 N.SATHISH KUMAR, J This Petition has been filed under Section 372 of the Indian Succession Act read with Order XXV Rule 6 of the Madras High Court Original Side Rules to grant succession certificate in favour of the petitioners.

2. The petitioners are children of R.Kasthuri Rangan and K.Vijayalakshmi. It is the case of the petitioners that their father died on 31.10.2021 at MINT Hospital, No.19/1, 1st Avenue Shastri Nagar, Adayar, Chennai 600020 and their mother died on 04.02.2021. The deceased was ordinarily residing at Flat No.28/55, Vijayalakshmi Apartments, Venkatarathinam Nagar, Adayar, Chennai 600020. The parents of the deceased predeceased him. The deceased was holding Postal Deposit NSS87 vide Account No.0830037469 at Adayar Sub Post Office. The deceased died intestate and though due and diligent search has been made for a Will, none has been found. The succession certificate is required for the purpose of withdrawing the postal deposit. The asset in respect of which the succession certificate is required is valued at Rs.7,35,621/-. No application

for a succession certificate in respect of any debt or security belonging to the estate of the said deceased has been made to any District Court or delegate or to any High Court. Hence, the petitioners have approached this Court for grant of succession certificate in the name of the petitioners with power to collect the debts and to receive interests and negotiate and transfer the deposits specified in the schedule.

3.The 4th petitioner examined himself as P.W.1 and marked Exs.P1 to P4. Ex.P1 is the original letter dated 05.10.2021 issued by the Postmaster, Adayar, insisting upon the petitioners to produce succession certificate in respect of NSS-87 bearing Account No.0830037469. Ex.P.2 is the computer generated death certificate of R.Kasthuri Rangan, the father of the petitioners. Ex.P3 is the computer generated death certificate of Mrs.K.Vijayalakshmi, the mother of the petitioners. Ex.P.4 is the computer generated legal heir certificate of the father of the petitioners. 4.Considering the averments made in the petition and the documents filed by the petitioners, I am satisfied that the petitioners have succeeded the Estate of the deceased R.Kasthuri Rangan. Therefore, the petition is ordered as prayed for and a direction for grant of Succession Certificate to the petitioners with power to collect the debts and to receive interests and

negotiate and transfer the deposits specified in the schedule, is issued. The petitioners are directed to render account once in a year. 06..10..2023 kmk
