Respondents Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd Respondent to prepare a panel of combined seniority list of Junior Assistants, Typists and Steno-Typists Grade - III based on the seniority assigned by the Tamil Nadu Public Service Commission and allot retrospective seniority to the Petitioners who were originally appointed as Steno-Typists Grade- III and who are now holding the posts of Assistants in the Tamil Nadu Ministerial Service for future promotions of the Petitioners as Superintendents and Junior Administrative Officers. This writ petition has been filed for the issue of a writ of mandamus, directing the 3rd respondent to act upon the representation made by the petitioners on 16.12.2022, wherein, the petitioners have sought for preparation of a panel of combined seniority list of Junior Assistants, Typists and Steno- Typists Grade-III, based on the seniority assigned by TNPSC and allot retrospective seniority to the petitioners and give them the attendant benefits. 2.When the matter came up for admission on 25.01.2023, this Court directed the learned Additional Government Pleader appearing on behalf of the respondents 1 to 4, to take instructions on the pending representation since such a representation was made pursuant to the liberty granted by this Court in WP.No.10818 of 2022, by order dated 06.06.2022. 3.The learned Additional Government Pleader appearing on behalf of the respondents 1 to 4 submitted that the representation made by the petitioners will be considered on its own merits and in accordance with law and a decision will be taken within the time frame fixed by this Court.
4.In view of the above, there shall be a direction to respondents 1 to 4, to consider the representation made by the petitioners on 16.12.2022 and deal with the same on its own merits and in accordance with law and take a decision within a period of eight weeks from the date of receipt of copy of this order. The petitioners are directed to make a fresh representation to respondents 1 to 4 along with all the relevant documents and also the copy of representation dated 16.12.2022 and a copy of this order.
