Learned Government Advocate (Crl.Side) appearing for the respondent submitted that earlier, this Court had granted interim anticipatory bail to the petitioners by an order dated 24.01.2023, with a condition to deposit a sum of Rs.30,00,000/- (Rupees Thirty lakhs only) to the credit of Crime No.10 of 2023 before the concerned Magistrate. Whereas, the petitioners have not complied with the above order and when the matter was listed on 02.03.2023 for reporting compliance, the petitioners have sought for extension of time to comply with the said condition on filing an Affidavit of Undertaking and this Court had also extended the time till 28.03.2023 to comply with the said order. He further submitted that the petitioners are taking undue advantage of the orders of this Court and till now, the petitioners have not paid the amount. 1/2 https://www.mhc.tn.gov.in/judis

Learned counsel for the petitioners submitted that the petitioners are unable to arrange the amount, further, this Court had also permitted the de-facto complainant to withdraw the amount, thereby, they have not complied with the order passed by this Court, however, they have preferred a Special Leave Petition in SLP(Crl) Diary No.12013 of 2023 before the Hon'ble Supreme Court against the order passed by this Court dated 24.01.2023 and the petitioners have also filed a memo before this Court.

4. Considering the above facts and circumstances of the case and also the submissions made by the learned counsel on either side, the interim anticipatory bail granted to the petitioners stands cancelled.

5. Accordingly, this Criminal Original Petition stands dismissed for non-compliance of condition. Consequently, the connected miscellaneous petition is closed.
