PRAYER :- Civil Revision Petition is filed under Article 227 of the Constitution of India, pleased to direct the learned Subordinate Judge at Tambaram, Chengalpattu District to expedite the proceedings in O.S. ORDER
The above Civil Revision Petition is filed for an early disposal of O.S.No.89 of 2023 pending on the file of the Sub Court, Tambaram, Chengalpattu.
2.The B diary extracts would show that the suit was filed on 21.06.2023 and the third respondent was set ex-parte on 20.02.2024. The first and second respondent had filed their written statement on 15.07.2024 after several adjournments. They have admitted that the petitioners are the owners of the suit schedule property and had also admitted that they have not transferred the lease amount to the petitioners. Not only are the respondents not paying the rents but they have also been dragging on the proceedings. The above matter has been pending for issues from 13.08.2024. On 25.11.2024, the matter has been once again adjourned for issues to 06.01.2025. Without framing issues there was a change of vakalath filed on behalf of the petitioners and both parties were directed to appear before Court on 01.02.2025. On 01.02.
2025 when they had appeared they were once again asked to appear on 01.03.2025. From the records it is seen that the Court has not framed the issues from 13.08.2012 to 01.03.2025. On 01.03.
20.03.2025.
3.Heard the learned counsel for the petitioners and perused the records.
4.Considering the fact that a long rope has been given by the Court below both for filing of written statement and for issues, direction is issued to the learned Subordinate Judge, Tambaram, Chengalpattu District, to dispose of the suit O.S.No.89 of 2023 within a period of six months from 20.03.2025.
