ORDER

(Order of the Court was made by THE ACTING CHIEF JUSTICE ) This Writ Petition has been filed, seeking for the issuance of a Writ of Certiorarified Mandamus, to quash the order of the 3rd respondent dated Nil and direct the respondents to grant

permission to the petitioner Association to conduct the Cock Fight in Nadhegoundanpudur Village, Alandhurai, Coimbatore District between 22.3.2017 and 26.3.2017.

2. According to the petitioner Society, it has been conducting Cock fight as a social event for several years without any objection from any quarter. In order to conduct such a cultural event in Nadhegoundanpudur village, Alandhurai, Coimbatore, it appears that the petitioner has made a representation on 17.2.2017 to the respondents, seeking necessary permission. However, by order, dated nil, the 3rd respondent has refused to accord the permission. Aggrieved by the same, the petitioner has come forward with the present Writ Petition.

3. Today, the petitioner Association has filed an affidavit, undertaking that no gambling will be conducted during the Cock Fight event and due to paucity of time, the petitioner seeks to conduct the event on different dates.

The learned Government Pleader appearing for the respondents would submit that since there was a ban in respect of conducting Jallikattu, similar such events, like Cock Fight, etc., were consequently banned and now the ban on Jallikattu has been removed by bringing new legislation. Therefore, if necessary direction is given by this Court, the authorities will consider the representation of the petitioner and give permission.

In view of the above facts and circumstances and as the relief sought for in the Writ Petition to conduct the event between 22.3.2017 and 26.03,2017 which according to the petitioner, due to paucity of time, unable to conduct the same, it cannot be granted. Hence, the Writ Petition is dismissed. No costs. However, it is open to the petitioner Association to make a fresh representation to the 3rd respondent police, seeking permission to conduct the Cock Fight in Nadhegoundanpudur village by mentioning convenient dates. On such representation being made by the petitioner Association, the 3rd respondent is directed to consider the same and pass appropriate orders therein forthwith.
