Today, when the matter is taken up for hearing the learned counsel for the appellants submitted that both the appellants died and he is not able to get instructions from the legal heirs to pursue this second appeal.

2.In the light of the above facts, this Second Appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petition is closed.
