This petition has been filed seeking for a direction to the third respondent to complete the investigation and file the final report within the time frame fixed by this Court.

2. Heard Mr.B.Kumarasamy, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondents.

3. When the matter was taken up for hearing, learned Additional Public Prosecutor submitted that the First Information Report was registered for offences u/s.457 and 397 IPC. After conducting the investigation, a closure report was filed as undetected before the Judicial Magistrate I, Udumalpet. It was further submitted that RCS notice was served on the petitioner in RCS No.35 of 2023.

4. This Court has already held that a case which is undetectable is only a stage in investigation and a closure report cannot be filed on that account. The case must be kept alive till it comes to a logical end. In view of the same, there shall be a direction to the third respondent to continue with the investigation effectively and complete the same as expeditiously 2/4

as possible by bringing the case to its logical conclusion in accordance with law.

This Criminal Original Petition is disposed of with the above direction.
