ORDER

The case of the petitioner is that the Sub Registrar, Walajapet, the second respondent herein has refused registration of his sale deeds dated 18.12.2020, and hence seek a direction to register the same.

2. Mr.T.M.Pappiah, learned Special Government Pleader takes notice for respondents 1 to 3. He made a statement on instruction that the sale deeds in favour of the petitioner, which he now seeks to register, was executed by the Power of Attorney of his vendor. However, on the same date, the Power of Attorney came to be cancelled and it also came to be registered Vide Cancellation Deed No.10466/2020 dated 18.12.2020 in the same office.

3. The learned counsel for the petitioner attempted to build the case about the time when his sale deeds were presented for registration as well as when the Power of Attorney was cancelled.

4. It is not so much about when the sale deeds were presented and when the authority came to know about the Power of Attorney. When once the authority came to know that the Power of Attorney is cancelled, he was fair enough not to register the same.

5. The writ petition is therefore dismissed, but with a liberty to the petitioner to approach the appropriate civil Court, if he is so interested for working out his remedies as per law. No costs.
