J U D G M E N T

The judgment and decree dated 18.10.2002 in C.M.A.No.18 of 2002, confirming the judgment and decree dated 06.03.2002 in H.M.O.P.No.104 of 2000, is under challenge in the present civil miscellaneous second appeal.

2. When the matter is taken up for hearing, the learned counsel appearing for the appellant made a submission that the issues between the parties has already been settled out of Court.

3. In view of such submission, no further adjudication needs to be entertained with reference to the grounds raised in the present civil miscellaneous second appeal. Accordingly C.M.S.A.No.23 of 2005 stands closed. No costs.
