JUDGMENT

Challenge in this second appeal is made to the Judgment and Decree passed in A.S.No.428 of 2006 dated 18.08.2007 passed by the V Additional City Civil Court at Chennai, confirming the decree and judgment dated 17.04.2006 made in O.S.No.4397 of 2004 on the I Assistant Judge, City Civil Court, Chennai.

2.When the matter is taken up, the learned counsel for the parties submitted that the matter has been settled between them and a compromise has been arrayed. A joint memo has been filed before this Court. 3.The learned counsel for the appellants prays that the Second Appeal may be disposed in accordance of the compromise memo filed before this Court. 4.It is seen that, respondents 3, 4, 5 and 6 are present. The 2nd 2/4

respondent is not present.

5.In the terms of compromise, it is recorded that the whereabouts of the 2nd respondent/Kasturi is not known and respondents 3 to 6 agreed to pay a sum of Rs.2,80,000/- jointly, if 2nd respondent/Kasturi made any claim towards the Bank.

6.In the result, this Second Appeal is disposed, in accordance with the compromise memo jointly filed by the appellants and respondents. The compromise memo shall form part and parcel of this order.
