(Crime No.16 of 2021) PRAYER: Criminal Original Petition is filed under Section 438 of Criminal Procedure Code to enlarge the petitioner on bail in the event of his arrest in Crime No.16 of 2021 pending investigation on the file of the Respondent.

ORDER

(The case has been heard through video conference) The petitioners, who are arrayed as Accused persons, apprehending arrest at the hands of the respondent Police for the offence punishable under Sections 6(4) TNSC (RDC3) Order 1982 and Section 7(1) (1) (ii) of EC Act, in Crime No.16 of 2021, on the file of the respondent Police, seek anticipatory bail.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent Police.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent Police submitted that the petitioners are brothers and the 2nd petitioner is owner of lorry. He would submit that based on a secret information, the respondent police had searched the vehicle of petitioners and found that there was illegal transportation of 19400 kgs. of PDS rice without permission from the Government authority. criminal case has been registered against the petitioners. He has further submitted that there are three previous cases pending against the petitioners. Hence, he vehemently opposed for grant of anticipatory bail to the petitioners.

4. In view of the submission made by the learned Addl. Public Prosecutor, there are three previous cases are pending against the petitioners, this is not a fit case to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
