2. In the light of the fair stand, which the learned Senior counsel for plaintiff is taking, it may not be necessary to set out the reasons qua COD in great detail. Suffice to say that the applicant has stated that there has been delay in collection / collation of documents and getting instructions leading to delay.

3. Learned counsel for plaintiff submits that the delay sought to be condoned is within the tolerance limit i.e., cap. To be precise, learned counsel for plaintiff submits that the delay sought to be condoned is within 120 days from the date of service of suit summons on the defendant concerned in the captioned application.
