Order IV Rule 1 of OS Rules, prays for a judgment and decree against the defendant : (i) Granting a decree for partition dividing the schedule mentioned properties into two equal shares and allot a separate half share to the plaintiff.

(ii) Directing the defendant to render true and correct account for the rental income collected from the schedule mentioned properties for the period from January 2008 to September 2017. (iii) To award cost of the suit.

(iv) Granting such further or other order as may be deem fit and proper in the circumstances of the case.

JUDGMENT

Today, when the matter is taken up for consideration, plaintiff appeared in person and seeks permission of this Court to withdraw the suit. He also made an endorsement to that effect.

2. In view of the same, this Civil Suit is dismissed as withdrawn. No costs.

3. Registry is directed to refund the entire court fee to the plaintiff as per rules.
