When the matter came up for hearing on 05.09.2019, Mr.V.Raghavachari, learned counsel who appeared for the appellant submitted that he has given change of vakalat and handed over the papers to the appellant for engaging some other counsel. Therefore, the Registry was directed to verify whether any counsel had entered appearance on behalf of the appellant. On verification, the Registry informed that no counsel had filed change of vakalat on behalf of the https://hcservices.ecourts.gov.in/hcservices/

appellant. Hence, the Registry was directed to list the matter on 10.03.2020 printing the name of the appellant. Subsequently, on 10.03.2020, though the name of the appellant was printed in the cause list, none appeared for them. In these circumstances, the Registry was directed to list the matter under the caption "for dismissal" on 12.03.2020. Though the matter has been listed under the caption "for dismissal" today, none appeared for the appellant. Hence, this Court has no other option except to dismiss the Civil Miscellaneous Appeal for non-prosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs. Consequently, the connected miscellaneous petition is closed.
