The petitioners, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 25(1B)(a) of the Arms 1/4

Act, 1959, in Crime No.255 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The allegation against this petitioners is that, the petitioners were intercepted by the police and on seeing the police party, they dropped the country made gun and ran away from the spot. Hence, this case. 3.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; since they are having bad antecedents in order to detain them, this case has been registered; that the petitioners herein are ready to co-operate for the investigation and that the petitioners are ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioners. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioners possessed one country made gun; that the investigation of this case is pending and there is two previous cases as against the first petitioner, similar in nature; there is one previous case as against the second petitioner, similar in nature. 2/4

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the petitioners had bad antecedents and one country made gun was recovered from the petitioners and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioners.
