Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the absence of the petitioner on 01.11.2021 before the Trial Court in C.C.No.12 of 2008 on the file of the learned XI Additional Special Sessions Judge for CBI cases, Chennai-600 001 in Crl.A.No.838 of 2013.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.A.G.RAJAKUMAR, Advocate for the petitioner and of PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition is filed seeking condonation of the absence of the petitioner on 01.11.2021 before the Trial Court in C.C.No.12 of 2008 on the file of the learned XI Additional Special Sessions Judge for CBI cases, Chennai-600 001 in Crl.Appeal No.838 of 2013. 2.The learned counsel for the petitioner submitted that he was affected by Covid-19 severely and was taking treatment for more than a month. That was the reason, he was not able to appear to the Court on 01.11.2021.

3.Recording the reason and accepting the reason, the absence to appear before the Trial Court on 01.11.2021 is condoned. Petition in M.P.No.1253 of 2022 in CRL.A.No.838 of 2013 is allowed. Petitioner is directed to continue to appear before the Court on future hearing without fail as ordered earlier.
