The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 309(4), 310(2) and 324(4) of BNS, 2023, in Crime No.149 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The allegation against this petitioner is that, the petitioner joined hands with other accused and involved in robbery of the lorry driver and taken away a sum of Rs.13,500/- and two mobile phones and also damaged the windshield of the lorry worth about Rs.5,000/-. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; that the petitioner herein is ready to co-operate for the investigation and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner along with the other accused involved in robbery and damaged the lorry windshield; that the investigation of this case is pending and there is one previous case, similar in nature and the property is also not recovered. 2/4

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the petitioner and other accused had involved in robbery and property is not yet recovered and one previous case of similar nature and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
