JUDGMENT

When the second appeal came up for hearing on 28.02.2023, there was no representation for the appellant and hence the Registry was directed to post this matter under the caption "for dismissal' on 01.03.2023. Even today, i.e., 01.03.2023, learned counsel for the appellant is not ready to argue the case.

2.In view of the above, the Second Appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
