Respondents/Defendants PRAYER:- Appeal against the Judgment and Decree of the Court of the Subordinate Judge, Thiruvallur dated 13/11/2008 in Appeal Suit No.86 of 2007 preferred against the Decree of the Court of the District Munsif, Thiruvallur dated 17/07/2007 in Original Suit No.161 of 1994.

DECREE:- This Second Appeal Coming on for hearing on this day upon perusing the Grounds of Appeal, the Judgments and Decrees of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mr.S.Saravanakumar, Advocate for M/s.M.Sudhakar, Advocate for the Appellant, and of Mr.N.Udaya Kumar, Advocate for the Respondents, and this Court doth Order and Decree as follows:- (i) That the Judgment and Decree dated 13.10.2008 made in A.S.No.86/2007 on the file of the Subordinate Court, Thiruvallur, partly allowing the appeal modifying the common Judgment and Decree dated 17.07.2007 made in O.S.No.161/1994 on the file of the District Munsif Court, Thiruvallur be and hereby is confirmed and the second appeal do stand is dismissed; (ii) That the Appellants herein/Defendants do pay to the Respondents herein/Plaintiffs Rs.10/- (Rupees Ten only) for

costs in opposing the Second Appeal.
