ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(B) and 420 of IPC and

section 4(1) and 76(1) of the Chit Funds Act, 1982 in Crime No.366 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was involved in conducting chit funds and collected a sum of Rs.6.07 lakhs from the de facto complainant and subsequently on maturing he repaid only 1.20 lakhs and failed to return back Rs.4.87 lakhs. Hence, the case has been registered.

3. The learned counsel appearing for the petitioner would submit that the money was borrowed as an education loan, the petitioner has not cheated the de facto complainant as alleged in the complaint and is ready to cooperate with the investigation. Therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is ranked as A2 and he joined hands with A1 and collected a huge amount and failed to return back the chit amount. She further submitted that the investigation is pending. Hence, she opposed the grant of anticipatory bail to the petitioner.

5. Considering the fact that a huge amount of Rs.4.87 lakhs has been swindled under the guise of conducting chit fund and failed to honour and so far

no amount is recovered, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 04-02-2026 MPA To
