Second Appeal No.438 of 2010 was already dismissed by this Court for non-prosecution vide order dated 19.11.2021.

2. This Civil Miscellaneous Petition is filed to set aside the order dated 19.11.2021 dismissing the Second Appeal in S.A.No.438/2010 for default and to restore the said appeal to file of this Hon'ble Court.

3. I have gone through the affidavit carefully and I am satisfied with the reasons assigned in the affidavit filed in support of this petition. Hence, this petition is allowed and the Second Appeal No.438 of 2010 restored to file.

4. Mr.N.Krishnankumar, representing M/s.Saravabhauman Associates is before this Court. Ms.G.Devi, learned Counsel for the appellant has requested to post the case along with S.A.No.233 of 2007 on 11.04.2023.

5. Post this appeal on 11.04.2023 along with S.A.No.233 of 2007 on 11.04.2023.
