No. Ka.No.E.Mi.Po/E and Pa/Va/Thi/Palam/Ko.Pu.Manu/A.No. 104/2021 and quash the same and consequently, direct the respondents to forthwith grant electricity connection to the petitioners premises being one shop at R.S.No.13/1, Thiruchitrambalam Village, Thiruchitrambalam Kootroad, Vanur Taluk, Villupuram District and award exemplary costs.

ORDER
The writ petition has been filed aggrieved over impugned order passed by the 3 rd respondent dated 20.11.2021 and consequently, direct the respondents to forthwith grant electricity connection to the petitioners premises being one shop at R.S.No.13/1, Thiruchitrambalam Village, Thiruchitrambalam Kootroad, Vanur Taluk, Villupuram District and award exemplary costs.

It is the case of the petitioner that the petitioner applied for an additional electricity connection for his commercial construction, however, the same was denied stating that though the petitioner is the son of one Sathyanathan and that the said Sathyanathan is in due of Rs.66,242/- in respect of the electricity connection No.43502563 and that only on payment of the said amount, new connection will be effected. In such circumstances, the petitioner approached this Court by way of writ petition in WP.No.23683 of 2017 challenging the same, wherein this Court set aside the impugned orders and remanded it to the 3 rd respondent with a direction to adjudicate on the stand of the petitioner and to pass a speaking order on merits. However, the said order was not complied with. Hence, a contempt petition was filed, wherein the Government Pleader representing the respondents informed that the third respondent had already passed orders and produced the copy of the impugned
order dated 20.11.2021 demanded Rs.66,242/- only on the payment of the said amount, the new electricity connected can be effect. Challenging the said order, the present writ petition has been filed.

The learned counsel for the petitioner submitted that the earlier disconnection is only against one Sathyanathan and he is not a owner of the property and he is only a tenant, for which, demanding the said amount from the petitioner is not sustainable. The petitioner is now way connected with the illegality committed by the said Sathyanathan.
4. Heard both sides and perused the materials available on record.
5. On perusal of the same, it is seen that admittedly the petitioner is a tenant and he has already given an undertaken affidavit before the respondents that he is agreed to pay the demanding amount. Suppressing the same, the petitioner has made another application for issuance of fresh service connection, which cannot be entertained. If the petitioner wants new service connection, he has to pay the demand amount.
6. In the result, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
