T.V.THAMILSELVI,J.

The petitioner, who apprehends arrest for the alleged offences punishable under Sections 420 and 120-B of I.P.C in Crime No.0645 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused received a sum of Rs.34,34,000/- from the defacto complainant and promised that they will secure M.B.B.S admission for his daughter. Thereafter they neither secured the admission nor returned the money back and thereby cheated the defacto complainant. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has not committed any offences as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of

anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit that the along with other accused received a sum of Rs.34,34,000/- from the defacto complainant and promised that they will secure M.B.B.S admission for his daughter. Thereafter they neither secured the admission nor returned the money back and thereby cheated the defacto complainant. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 09.02.2023 smn
