Crl.M.P.No.2583 of 2023 in Crl.A.No.3117 of 2023 M.SUNDAR, J., and M.NIRMAL KUMAR, J., (Order of the Court was made by M.SUNDAR.J) Captioned 'Criminal Miscellaneous Petition' ['Crl.MP' for the sake of brevity] has been filed with a prayer for 'Condonation of Delay' ['COD'].

2. COD sought is 138 days delay in filing the criminal appeal against the judgment and conviction in S.C.No.119 of 2018 on the file of Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Chennai and the date of judgment and conviction is 29.06.2022.

3. Mr.N.Baaskaran, learned counsel for petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor, who accepted notice on behalf of sole respondent, are before us.

4. The reason as articulated is, relatives were informed and requested to take steps for filing appeal but they failed to do so.

5. Having heard learned counsel for petitioner, having perused the case file, considering the facts and circumstances and nature of the case, we are inclined to acceded to the prayer. Delay condoned.
