Apprehending arrest in connection with Crime No.446 of 2024 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code, 1860, the present petition has been filed seeking anticipatory bail.
2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that the petitioner has hired the car from the Zoom App and given to
one Anthoniraj and the said Anthoniraj did not return the car. He would submit that the petitioner has also paid an amount of Rs.1,00,000/-. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.
3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that, the petitioner has hired the car viz., Maruti Swift Red colour bearing Registration No.TN-11-BE-5421 in a Zoom App and later, did not return the car. He would further submit that the petitioner has also removed the GPS in the car to prevent it to be traced and the car is not yet recovered.
4. Heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, considering the facts and the submissions, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 22.01.2025 dsn
