PRAYER : The Second Appeal filed under Section 100 C.P.C., against the decree and Judgement dated 20.04.2009 on the file of the Sub Court, Mannargudi in A.S.No.38 of 2008 reversing the Judgement dated 12.08.2008 in O.S.No.19 of 2005 on the file of District Munsif Court, Mannargudi.

Mr.S.Chandrasekaran JUDGEMENT (Heard through video conferencing) This Second Appeal is filed to set aside the judgement and decree of the learned Sub Judge, Mannargudi in A.S.No. 38 of 2008 dated 20.04.2009 in reversing the judgement and decree of the Court of the District Munsif Court, Mannargudi in O.S.No. 19 of 2005 dated 12.08.2008.

2. When the matter is taken up today for hearing, the learned counsel for the appellant would submit that he has no instructions from the appellant. The appeal is of the year 2009, since the appellant does not show any interest to prosecute the appeal.

3. In view of the same, the Second Appeal stands dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is also closed.
