BY ITS [ RESPONDENT ] DEPUTY SUPERINTENDENT OF POLICE, ARAKONAM DIVISION, VELLORE (ARAKONAM ALL WOMEN P.S CR.NO.12 OF 2007) Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed by this Honble Court in Crl.M.P.No.14903 of 2017 in C.A.No.657 of 2017 dt 30.11.2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.KARTHIKEYAN, Advocate for the petitioner and of M/S.V.SARATHA DEVI, GOVERNMENT ADVOCATE [CRL.SIDE] on behalf of the Respondent the court made the following order:- This miscellaneous petition has been filed seeking to modify the condition imposed on the petitioner by this Court vide its order dated 30.11.2017.
This Court by an earlier order dated 09.11.2017 had granted bail to the petitioner imposing condition that the petitioner shall appear before the learned Judicial Magistrate, Sholinghur, Vellore, and subsequently by order dated 31.11.2017 it was modified that the petitioner shall appear before the learned Chief Metropolitan Magistrate, Egmore, Chennai on the first working day of every English Calender month, at 10.30 a.m., pending appeal. The learned counsel appearing for the petitioner would submit that the condition imposed by this Court has been complied with regularly for more than one year and hence he seeks to modify the same.
The learned Government Advocate (Crl.Side) appearing for the respondent police has also acknowledged the above fact. https://hcservices.ecourts.gov.in/hcservices/
In view of the above and having regard to the reasons stated in the affidavit filed in support of this miscellaneous petition, the condition imposed on the petitioner by order dated 30.11.2017 that the petitioner shall appeal before the learned Chief Metropolitan Magistrate, Chennai, shall stand removed and deleted henceforth.
