The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 296(b), 115(2), 118(1) and 351(3) of BNS, 2023, in Crime No.539 of 2025 on the file of the respondent 1/4
Police, seeks anticipatory bail.

The earlier criminal original petition in Crl.O.P.No.35166 of 2025 seeking anticipatory bail has been disposed of by this Court by an order dated 19.12.2025 on the following reasons: "6.Considering the nature of the allegations and the petitioner is having eight previous case, this Court is not inclined to grant anticipatory bail to the petitioners."

The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and hence, seeks anticipatory bail. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that still the case is under investigation. 4.
Heard the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order.
