No.49 of 2007 on the file of the Sub-Court, Udhagamandalam, reversing the Judgment and Decree dated 09.07.2007 passed in O.S. No.56 of 2005 on the file of the District Munsiff, Kotagiri.

J U D G M E N T
(The case has been heard through video conference) The parties have finally reached an agreement and have reduced their agreement in the form of a joint memorandum of compromise and filed the same on 30.07.2021 which has been signed by both the parties as well as their respective counsel.
2. The respondent is in possession of a portion of the property through a tenant. The counsel for the respondent undertakes that by 15.08.2021, the attornment of tenancy in favour of the appellant/plaintiff shall be concluded.
3. The memorandum of compromise dated 30.07.2021 is taken on file and a decree passed in terms of the memo of compromise with an additional Clause that the attornment of tenancy in favour of the appellant in respect of the portion that is now in the possession of the respondent/defendant would be completed by 15.08.2021.
