JUDGMENT

(Judgment of the Court was delivered by A.SELVAM, J.) This Civil Miscellaneous Appeal is directed against the order dated 24.02.2016 passed in H.M.O.P.No.91 of 2015, by the Family Court, Chengleput.

2.The appellant herein, as petitioner, has filed H.M.O.P.No.91 of 2015, on the file of the trial Court under Section 13(ia) and 13(ib) of the Hindu Marriage Act, 1955, praying to dissolve the marriage held on 28.1.2008, wherein, the present respondent has been shown as respondent. 3.The trial Court, after considering the available evidence on record, has dismissed the petition. Against the dismissal order, the petitioner, as appellant, has filed C.M.A.No.1429 of 2017 on the file of this Court and during pendency of the same, the matter has been referred to Mediation and Conciliation Center, wherein, a compromise has been effected between the parties and to that effect a joint compromise memo has been filed.

4.Considering the aforesaid factual circumstances, C.M.A.No.1429 of 2017 is liable to be disposed of on the basis of terms of joint compromise.

In fine, this Civil Miscellaneous Appeal is disposed of on the basis of terms of joint compromise memo. The terms mentioned in the Joint compromise memo shall form part of the decree. No costs.
