Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the respondents to disburse the difference sum of interest paid towards the belated disbursement of

the petitioner's commuted value of pension to the petitioner with further interest at the rate of 6% per annum from the said date of entitlement to till the date of actual payment within a time limit to be stipulated by this Court.

ORDER

This Writ Petition has been filed for direction directing the respondents to disburse the different sum of interest paid towards the belated disbursement of the petitioner's commuted value of pension with further interest at the rate of 6% per annum from the date of entitlement till the date of actual payment.

2. The case of the petitioner is that he retired from service from the respondents Corporation, however, his retirement benefits was settled belatedly. Therefore, the petitioner approached this Court earlier seeking interest for the belated payment of his retirement benefits and this Court directed the respondents to pay interest at the rate of 4% p.a. for the belated payment of his terminal benefits.

3. The grievance of the petitioner is that insofar as the interest towards commuted value of pension is concerned, the respondents had disbursed only lesser amount than the one as calculated by the petitioner. Hence, the petitioner seeks for the difference in interest amount paid towards belated payment of commuted value of pension to the petitioner. In this regard, the petitioner has also submitted representation to the respondents. Since the same was not considered, the present writ petition has been filed.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

5. Considering the limited nature of the relief sought for in this writ petition, the respondents are directed to pay the eligible amount, if any, towards difference in interest amount paid for belated payment of commuted value of pension to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands

disposed of. No costs.
