A.Nos.578 and 579 of 2019 P.T.ASHA, J., Though the order dated 23.01.2019 was passed by this Court and the applicant had undertaken to initiate arbitral proceedings within a period of four weeks no arbitral proceedings have been initiated till date. There appears to be no manifest intention to arbitrate the dispute between the parties and the applicant is only keen on obtaining interim orders in violation of the provisions of Section 9(2) of the Act.

Hence, these Applications are dismissed. It is needless to state if the applicant moves the Arbitral Tribunal it is open to the applicant to file such application as advised.
