ORDER
The petitioner, claims title to the property at Door No.5/999, Selvapuram, Karaimedu Road, Coimbatore 641 301.
2. With respect to that particular property, the petitioner is locked in a civil litigation with one M.Udayakumar.
3. In the civil Suit, a judgment adverse to the petitioner had been passed.
4. But the petitioner had exercised the statutory right available and had filed an Appeal. In the meanwhile, the petitioner apprehended that the said M.Udayakumar, had changed the electricity service connection to his name.
5. A representation in that regard had been given by the petitioner on 07.01.2023.
6. The learned Standing Counsel who had taken notice on behalf of 2/5
the respondents, quite fairly stated that it is not known, whether the said M.Udayakumar had given any formal application for change in the name of the service connection.
7. At any rate, a mandamus is issued that even if such application is given, the respondents will necessarily have to enquire with the petitioner and also examine the nature of Appeal now pending and thereafter, take a considered decision. No such order for change in the name of the electricity connection can be made without enquiring the petitioner.
8. Holding as above, the Writ Petition stands disposed of. No order as to costs.
