IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 23.03.2016
CORAM:
THE HON'BLE MR. JUSTICE SATISH K. AGNIHOTRI and THE HON'BLE MR. JUSTICE M. VENUGOPAL W.P. No.10760 of 2016 K. Maruthan Petitioner vs.
The Revenue Divisional Officer Harur Dharmapuri District Respondent Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the respondent to issue community certificate to the petitioner's son M.S. Pavan that he belongs to Kurumans (ST) community based upon the community certificate already issued to the petitioner and his sister and also verified by the State Level Scrutiny Committee in Proceedings No.10890/CVIII-2014 dated 06.03.2015. For petitioner Mr. S. Doraisamy For respondent Mrs. T.T. Girija, Government Advocate
ORDER
(delivered by SATISH K. AGNIHOTRI, J.) Mrs. T.T. Girija, learned Government Advocate, accepts notice for the respondent. With consent, the writ petition is taken up for final disposal, at the admission stage itself. The petitioner, K. Maruthan, S/o D. Krishnan, has preferred this writ petition seeking a writ of mandamus directing the respondent to issue Kurumans (ST) community certificate to his son M.S. Pavan, based upon the community certificate already issued to himself and his sister, which has been verified and confirmed by the State Level Scrutiny Committee vide Proceedings No.10890/CVIII-2014 dated 06 March 2015.
The petitioner made an application to the respondent on 17 March 2015 seeking Kurumans (ST) community certificate to his son, annexing therewith, his community certificate and also his sister's community certificate duly verified and confirmed by https://hcservices.ecourts.gov.in/hcservices/
the State Level Scrutiny Committee, as aforestated. Finding no response to his application, he has come up with the instant writ petition seeking the aforestated relief. Needless to state that a community comprises close relations. Once the petitioner has been issued with Kurumans (ST) community certificate and further, when the petitioner's own sister has been declared as one belonging to Kurumans (ST) community by the State Level Scrutiny Committee, there is no reason to take a contrary view in respect of the petitioner's son. However, the authority concerned, viz., the respondent is competent to verify the relationship of the brother and sister, whose community status stands concluded vide proceedings dated 06 March 2015 of the Tamil Nadu State Level Scrutiny Committee. Thus, we dispose of this writ petition with a direction to the respondent to pass orders on the petitioner's application dated 17 March 2015, accordingly, within a period of four weeks from the date of receipt of a copy of this order. Costs made easy.
