It is represented that CMP.No.462 of 2015 was pending even before passing the order of dismissal in the Second Appeal.

2.Since, there was an order of dismissal in the main appeal viz., S.A.No.477 of 2005, CMP.No.462 of 2015 stands automatically closed.

3.Since the sole respondent died, it is open to the respective parties to bring the legal representatives of the sole respondent with necessary application thereto.

4.The Registry is directed to delete the name of Mr.T.Murugamanickam, learned counsel for the respondent and post the matter after two weeks.
